Temporary simplified approval procedures in Russia in 2023

Decree 353 “On the specifics of permitting activities in the Russian Federation in 2022” adopted on March 12,2022, provides temporary simplified procedures for obtaining or reissuing licenses and approvals in Russia.

 Annex 18 of the Decree describes the specifics of conformity assessment of products. The decree only applies to the Russian market, not other countries of EAEU, for which the common requirements remain valid.

Simplified declarations of conformity

Until September 1, 2024,it is allowed to replace the certification and declaration of products normally carried out based on sample testing in the accredited testing labs, with temporary declaration of conformity based on the applicant's own evidence in Russian language.

Main features:

  • Temporary declarations can only be issued for a batch or a single product for a validity period of 6 months.
  • A regular approval must be obtained within these 6 months — rule introduced by the update of 10.07.2023, and becomes active from 01.09.2023.
  • The applicant for such products can be a legal entity registered in Russia only, not other EAEU countries.
  • Such products cannot be marked with a EAC mark of conformity, and cannot be openly sold until a regular approval is obtained and the EAC mark is applied.
  • The customs clearance procedure for such products will not require submission to the customs authorities of the documents used the basis for registration of the temporary declaration of conformity, and of the documents confirming the right of the declarant to use the temporary declaration of conformity.
  • It is allowed to pick samples from the batches of products imported under a temporary declaration of conformity for obtaining of regular certificates and declarations.
  • The temporary declarations may not be published in the national register of approvals upon the decision of the applicant, however in this case the products cannot be sold in retail.

The list of products for which temporary declarations are not allowed is established by Decree Nr. 4616 dated 02.11.2022 of Ministry of Industry and Trade of Russia.

Other simplifications

  1. Approvals are not required during the customs clearance of spare parts of products previously released into the market of Russia. This refers to parts, assemblies or blocks of finished goods, intended to replace or repair similar parts, accessories, components, raw materials, single units in the quantity provided for by single foreign trade agreement, imported exclusively for the declarant's own use.
  2. The customs clearance procedure will only require the approval number, without providing original certificates or declarations.
  3. Importers are not required to provide a confirmation of the right to use existing serial (long-term) approvals to the customs authorities.
  4. It is allowed to import into the territory of the Russian Federation products that are not marked with the EAC or CTP marks of conformity. The marking is still required prior to sales of such products to consumers.
